1. Agreement to Terms

These Terms & Conditions govern your use of seenstick.com and any digital marketing services, website development, or courses provided by Seenstick ("we", "us", "our"), based in Kushinagar, Uttar Pradesh, India. By contacting us, engaging our services, or making a payment, you agree to these terms.

2. Our Services

Seenstick provides digital marketing services including but not limited to Google My Business setup, SEO, social media management, Google & Meta advertising, website development, video/content production, and digital marketing courses. Exact scope, deliverables, and timelines for any project will be confirmed with the client directly (by call, message, or written agreement) before work begins.

3. Client Responsibilities

• Providing accurate business information, content, and access (e.g., to Google/social media accounts) needed to deliver the service.
• Responding to requests for approvals, feedback, or content in a timely manner, as delays on the client's side may affect project timelines.
• Ensuring that any content, images, claims, or information the client provides for use in campaigns is accurate, lawful, and does not infringe on any third party's rights.

4. Payments

• Service fees and payment schedules will be communicated before work begins, and payments are accepted through our payment gateway (Cashfree Payments) or other agreed methods.
• For paid advertising campaigns (Google Ads, Meta Ads, etc.), the advertising budget/ad spend is separate from our service fee and is paid directly to the respective ad platform, unless otherwise agreed in writing.
• Fees already paid for work completed or in progress are generally non-refundable, except where required by law or explicitly agreed with the client in writing.
• Applicable taxes (such as GST, where applicable) may be added to invoices as per prevailing Indian tax law.

6. Election & Political Campaign Services

For clients engaging Seenstick for election or political campaign promotion, the following additional terms apply:

• The client is solely responsible for ensuring that all campaign content, claims, and promotional material comply with the Election Commission of India's Model Code of Conduct and all applicable election laws, including any pre-certification or expenditure disclosure requirements.
• Seenstick provides technical and creative execution of campaign material (design, posting, ad management) based on content and direction provided or approved by the client. We do not independently verify political claims made in client-provided content.
• Seenstick does not endorse any political party, candidate, or ideology; our involvement is limited to providing marketing services as a paid service provider.
• Any advertising expenditure disclosure required under election law is the client's responsibility to report to the appropriate authority.

7. Intellectual Property

Upon full payment, final deliverables (such as a completed website or designed creatives) created specifically for the client become the client's property, unless otherwise agreed. Seenstick retains the right to showcase completed work in its portfolio, website, or social media for promotional purposes, unless the client requests confidentiality in writing.

8. Confidentiality

We treat client business information, login credentials, and campaign data as confidential, and will not share them with third parties except as necessary to deliver the agreed services (e.g., ad platforms, hosting providers).

9. Cancellation

Either party may discontinue an ongoing service engagement with reasonable prior notice. Fees for work already completed up to the cancellation date remain payable. Any pre-paid advertising budget not yet spent with a platform will be handled as per that platform's own refund policy.

10. Limitation of Liability

To the extent permitted by law, Seenstick's liability for any claim arising from our services is limited to the amount paid by the client for the specific service in question. We are not liable for indirect or consequential losses, including loss of business, profits, or reputation.

11. Governing Law

These terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of the courts in Kushinagar, Uttar Pradesh.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. The revised version will be posted on this page with an updated date.
